Annals of southwest Virginia, 1769-1800, Fincastle County [Kentucky] --1773-77

"At a Court Held and continued for Fincastle County the third day of Nov. one thousand seven hundred and seventy three [1773].

PRESENT Walter Crockett James Thompson Arthur Campbell James MeCorkle Gent. Justices On the complaint of Shadrack McNew against John L- and Alexander Willson for assaulting on the highway It is ordered that the sheriff take them into Custody until they give Security for their appearance at the next Court to be held for this County and for their good behaviour til then. Whereupon Edward McNew and Henry Willis acknowledged themselves Indebted to our Sovereign Lord the King in the sum of fifty pounds Each to be Levied on each of their Goods Chattels Lands and Tenements upon condition that they appear at the next Court to be held for this County to give Testimony against John Lester and Alexander Willson."

THIS day came the parties by their Attornies and there- upon canie also a Jury To wit Elisha McNew, Andrew Lammey, Archelaus Brumley, Thomas Hardwick, David Watson, Joseph Meek, William Lowrey, Samuel Scott, Thomas Lusk, Joseph Vance, William Golloher and Joseph Vance who being elected tried and sworn the truth to speak upon the issue joined upon their Oaths do say that the defendant is guilty in manner and form as the Plaintiff against him hath declared and that they do assess the Plaintiffs damages by occasion thereof to five pounds besides his Costs, Therefore it is considered by the Court that the Plaintiff recover against the said defendant his damages aforesaid in form aforesaid assessed and his Costs in this behalf Expended and the defendant in Mercy & c.
Costs Three hundred and fifty pounds of neat Tobacco and fifteen shillings Attornies fec.

" My name is Jno. Bowman aged 66 years and reside in Cherokee co. Ala. at the fork of the Little River
&& during the war lived during the war. I was no kin to the claimant Charles Sutterlin but am a
third or 4th cousin to his widow Joanna [McNew] Sutterlin. But have no personal interest in her claim.
I knew Mr. Sutterlin for a year or two before the war began and during the war and talked often with
him about the Rebellion...  "
