"Articles of Agreement Between Brensley Barnes of the County and State of N Carolina of the one part , and Jehu Barnes & State aforesaid Witnesseth that I the Said Brinsley Barnes doth Covenant and agree to and with the said Jehu Barnes and by presents Doth give to him the said Jehu Barnes one Certain tract or parcel of Land Lying Situate and being in said County of Will and on the Lower Littel River of the Calaba Containing Two hundred and Ninety Acres to him and his heirs forever and I do also give unto him the S. Jehu Barnes all the rest of my whole Esta Whatever for and in Consideration that the Said Jehu Barnes as well find the said Brinsley Barnes Sufficient Maintenance During the whole course of his Life ---- and I the Said Jehu Barnes do Obligate myself my heirs by the presents doth Covenant and agree to find the said Brensley Barnes Sufficient Maintained During the whole course of his Life 1 In Witness whereof we have hereunto set our hand and seal the fifth day of May one Thousand Seven hundred and Ninety C. is

"This Indenture made this 9th day of October in the year of our Lord one thousand eight hundred and one. Between Jesse Copher and Elizabeth his wife of the County of Clarke and State of Kentucky of the one part and Brinsley Barnes of the County of Fayette and State aforesaid of the other part Witnesseth that for and in consideration of the sum of One hundred pounds current money of Kentucky to them the said Jesse Copher and Elizabeth his wife in hand paid at and before the ensealing and delivery of these presents the receipt whereof they and each of them doth hereby acknowledge themselves entirely satisfied with , and by these presents doth grant bargain sell alien & confirm unto the said Brinsley Barnes a certain tract or parcel of land containing two hundred acres , lying in Fayette County it being the Plantation that the said Copher formerly lived on and bounded as fol lows , to wit Beginning at a beach in the old line , and running West 220 poles to a Sugartree hornbeam and degured thence North 145 poles to a Sugar ash and Cherry tree , thence East 220 poles to two white oake & a Walnut , thence South 145 poles to the Beginning together with all and Singuler the houses buildings waters water courses profits commodities heriditaments and appurtenances whatsoever to the same belong ing or in any wise appertaining unto the only proper use and behoof of him the said Brinsley Barnes his heirs and assigns forever . And further the said Jose Copher and Elizabeth his wife doth Covenant grant and agree with the said Brinsley Barnes his heirs and assigns that they do stand right fully and lawfully possessed of in and to the said land and premisses with a good sure and perfect right of inheritance , and that they have good right and lawful authority to sell and convey the same free from any other 112 former grants gests bargains sales dower or right in dower my gages or incumbrances of whatsoever kind and that they the said Jesse Copher and Elizabeth his wife will warrant and forever defend the said land and premises before mentioned and sold from the claim of them the said Jesse Copher and Elizabeth his wife or any person claiming by from or under them or their hers or any other claim or claims of whatsoever kind that shall arise against the same unto the sa in opposition to the peaceable possession of the said Brinley Barnes his heirs Executors administrators or assigns of in and to the said land premises before mentioned and sold . In witness whereof the said Jesse Copher and Elizabeth his wife hath hereunto set their hand and Seals the date above written Jesse Copher

"This indenture of bargain & Sale was this day proved before me as Clerk of the Court for the County aforesaid , and duly acknowledged by Jesse Copher a party thereto and is admitted to record in my office Teste Levi Todd C. F. C.

"The Commonwealth of Kentucky to William Suddeth and Benjamin J. Paul Gentlemen Justices Whereas Jesse Copher and Elizabeth his wife by their certain Indenture of bargain and Sale bearing date the 9th day of October 1801. have sold & conveyed unto Brinsley Barnes the fee simple estate of two hundred acres of land with the appurtenances lying and being in the County of Fayette . And whereas the said Elizabeth Cannot conveniently travel to our said County Court to make acknowledgement of the said Conveyance . Therefore powers given you or any two of  you to receive the acknowledgement which the said Elizabeth shall be willing to make before you of the conveyance aforesaid contained in the said Indenture which is here unto annexed . And you are therefore commanded that you do go personally to the said Elizabeth and receive her acknowledgement of the same , and examine her privily and apart from the said Jesse Copher her husband whether she doth the same freely and voluntarily without his persuasions or threats and whether she be willing that the same should be recorded in our said County Court . And when you have received her acknowledgement and examination as aforesaid , that you distinctly and openly certify the same to the said County Court under your hands & seals sending there the said Indenture ; and this writ Witnes of or Lode , Clerk of our Said Court this 6th day of October 1801 . and in the 10th year of the Commonwealth

Pursuant to the within Dec****? to us directed we have personally allowed on the within mentioned Elizabeth Copher and examined the said Elizabeth as herein directed Seperate and apart from her said husband who freely relinquished her right of dower in the within men Exand & tioned land and desires the same to be recorded in the county coms of Fayette County Given under our hands & seals this 10th day of October 1801 .  Wm.
